Procedural Safeguards

Procedural safeguards refers to the mechanisms in place to ensure a parent’s rights and guarantees are fully understood and respected throughout a child's participation in special education services. Understanding a parent’s rights and guarantees set by the IDEA is mandatory before critical discussions and decision making begin taking place.

Learning Objectives:

  • Define the procedural safeguards notice
  • Describe a parent’s rights for notification, participation, dispute resolution options, and independent evaluation
  • Identify when parental consent is required
  • Define surrogate parents and when one should be assigned
